Job Description Job Description The Role You will run enforcement matters end to end-from default demand through judgment and collection-with genuine carriage of your own files and regular court attendance. You will work directly with the company's principals and external counsel, and you will have a meaningful say in how the enforcement process is built. What You Will Do Litigation & Court Work • Draft, issue, and serve Plaintiff's Claims in Ontario Small Claims Court (to $50,000) against corporate merchants and personal guarantors. • Appear at settlement conferences, motions, and trials; argue motions and take default judgment. • Review Defences and Defendant's Claims; prepare responding materials and settlement positions. • Conduct examinations in aid of execution, including of officers and directors of corporate defendants. • Coordinate out-of-province filings, including Alberta, and instruct agents and external counsel where matters fall outside Ontario paralegal scope. Post-Judgment Enforcement • Issue writs of seizure and sale electronically through Teranet / WritFiling, including renewals. • Prepare and file notices of garnishment, certificates of judgment, and enforcement motions. • Track and pursue judgment recovery to conclusion; escalate to bailiffs, sheriffs, and counsel as required. Pre-Litigation & File Management • Draft demand letters and notices of default and intention to enforce security. • Carry negotiations with debtors and opposing counsel-firm, reasonable, settlement-open, and always moving the file forward. • Own limitation-period tracking, service deadlines, and court diarization across a large active docket. • Maintain matters, deadlines, and documents in Clio to a clean, audit-ready standard. Security & Insolvency • Prepare and register PPSA financing statements in Ontario and other provinces; conduct searches and manage renewals and discharges. • Monitor insolvency filings; prepare proofs of claim and creditor correspondence in NOI, proposal, bankruptcy, and receivership files. • Assist with skip tracing, asset and corporate searches, and file investigation. Process • Help refine SOPs, templates, and workflows as the enforcement platform is built out. • Report on portfolio and file status to management. What We Are Looking For Required • Licensed P1 paralegal in good standing with the Law Society of Ontario. • Comfortable appearing in Small Claims Court and running your own files. • Strong drafting ability across claims, demands, motion materials, and correspondence to opposing counsel. • Organized under volume, with the ability to hold one hundred-plus active matters without a deadline slipping. • Clear, professional written and verbal communication; able to hold a firm position without escalating it. Strong Assets • Experience in debt recovery, collections, judgment enforcement, or creditors' rights. • Working knowledge of the PPSA, the Rules of the Small Claims Court, and post-judgment enforcement. • Experience with Clio or comparable practice-management software, and Teranet / WritFiling. • Familiarity with commercial finance, merchant cash advance, or factoring documentation. • Insolvency exposure, including BIA proposals, bankruptcies, and receiverships. • Comfort with technology and AI-assisted drafting tools.
