Position Overview The Hybrid Real Estate Law Clerk / Default Recovery Specialist supports both real estate mortgage closings and default recovery activities. Reporting to In-house Legal Counsel, this role prepares and manages legal documentation, coordinates mortgage closings and registrations, conducts title and security reviews, and assists with enforcement, recovery, discharge, and portfolio management activities. The position requires strong real estate law knowledge, mortgage administration experience, sound judgment, precise documentation, and the ability to communicate effectively with borrowers, lenders, solicitors, title insurers, property managers, real estate agents, and internal stakeholders. Key Responsibilities • Manage real estate mortgage files from opening through closing, including preparation of mortgage documents, reporting letters, accounts, registrations, and post-closing follow-up. • Prepare and process private mortgage transactions using Unity, Conveyancer, Teraview, Microsoft Office, Adobe Acrobat, Excel, and related systems. • Conduct title searches and security reviews; identify, escalate, and help resolve title, documentation, compliance, or account discrepancies. • Prepare partial and complete discharges of security, review discharge statements, and complete required system updates and postings accurately and on time. • Manage a portfolio of impaired or delinquent mortgage accounts, including continual follow-up, file review, enforcement coordination, recovery recommendations, and loss mitigation strategies. • Instruct and coordinate with solicitors, title insurers, property managers, real estate agents, appraisers, and authorized third parties to support closings, enforcement remedies, asset disposition, and recovery activities. • Review mortgage commitments, agreements of purchase and sale, title instruments, tax certificates, insurance confirmations, account histories, and related documents to safeguard against loss or out-of-pocket expense. • Communicate clearly and professionally with borrowers, clients, lenders, solicitors, insurers, and internal stakeholders, ensuring customers are treated respectfully and understand the closing, discharge, recovery, or enforcement process. • Develop concise recommendations for management regarding workout solutions, legal action, marketing proposals, file strategy, and risk mitigation. • Maintain accurate electronic files, documentation, reporting, account information, and follow-up records while meeting internal controls, regulatory requirements, and deadlines. • Support portfolio coverage, reporting backup, training initiatives, and process improvements as required. • Perform other legal, administrative, recovery, compliance, and related duties as assigned. Skills, Knowledge, and Qualifications • Minimum 5+ years of residential real estate law clerk experience, preferably including private mortgages, mortgage enforcement, default recovery, or legal collections. • Strong understanding of real estate law, mortgage remedy law, title matters, private lending, Mortgage Investment Corporations, and mortgage/investment payment processes. • Ability to independently manage real estate, discharge, recovery, and enforcement files from start to finish with minimal supervision. • Proficiency with Unity, Conveyancer, Teraview, Microsoft Office, Excel, Adobe Acrobat, electronic document management, and follow-up systems. • Excellent organizational, analytical, communication, interpersonal, math, problem-solving, and time-management skills. • Law Clerk, Legal Assistant, Paralegal, or related diploma/certificate is an asset; post-secondary education preferred. • Demonstrated ability to manage confidential and sensitive information, work under tight deadlines, prioritize competing files, and maintain accuracy in high-volume environments. • Sound judgment, professionalism, relationship-building skills, discretion, and a customer-focused approach.
